Land Conversion
Land Conversion is a form of land development process known as “variation of conditions, restrictions and categories” as provided for in the National Land Code 1965. A landowner may apply to the Local State Authority for alteration on imposition of category of land use, removal from the land title expression to which the land is subject or the rescission or amendment of any express condition or restriction in interest to enable a landowner to use or develop his land accordingly and for purposes other than that allowed.
Each application for land conversion will depend on whether the Local State Authority will grant approval. Normally, the State Authority will process applications for land conversions upon satisfaction of certain pre-determine requirements as provided for in National Land Code 1965 (NLC). Upon approval, the State Authority shall direct that the category of land use be endorsed in the document of title to the land and the existing category shall be deleted. The Local State Authority may at their discretion impose conditions which are fair and reasonable and related to the permitted development of the land in question. Applications for land conversion and sub-division can be made simultaneously aimed of speeding up the development of housing projects.
Land conversions also encompass applications for surrender or realienation whereby landowner may surrender any lots on condition that certain portions of land be immediately realienated to the landowner in different units.
