Under the Malaysian Legal System, all criminal cases are administered under the supervision of the direction of Attorney-General Chambers which is headed by Attorney General. Under the criminal procedure code, the AG has the sole discretion to conduct continue or discontinue any criminal cases in Malaysia.
Normally, a person who is accused of a criminal offence is charged in the criminal court whereby the offences levied against the accused person will be stated in the charge sheet. Where upon the accused has the right to plead guilty or not guilty. The accused has the constitutional right to be represented by a lawyer during this stage.
Prior to the person being charged with a criminal offence, the investigative authorities have to conduct a preliminary investigation and further directions on the cases will be given by the Attorney General Chambers assisted by Deputy Public Prosecutors and thereupon to decide whether to charge the person with a criminal offence in the court.
The list of criminal offences can be found in various statutes or laws and also in Criminal Procedure Code where the list offences and the punishment are stated in detail.
Nevertheless, certain criminal cases have to be heard in the High Court e.g. murder or drug-trafficking offences whereas the Sessions Court and Magistrate Court have their respective jurisdiction to hear criminal cases as provided by the Court of Judicature Act 1964.
Customs Department, Immigration or Anti-Corruption Agency are some of the departments that conduct criminal cases. A person accused of a criminal offence is best advised to seek legal advice and assistance.
