Local Government Act 1976
The Local Government Act 1976 stipulates that all business premises must apply for a license.
Effects of non-Compliance
Any person who is guilty of any offence against this Act or any by-law, rule or regulation for which no penalty is expressly provided shall on conviction be liable to a fine not exceeding RM2,000 or to a term imprisonment not exceeding 1 year or to both. (Section 119).
Licenses
A local authority in the granting of any license or permit may prescribe the fees for such license or permit and the charges for the inspection or supervision of any trade, occupation or premises in respect of which the license is granted.
The local authority may at its discretion refuse to grant or renew any license without assigning any reason therefore.
Every person to whom a license has been granted shall exhibit his license at all times in some prominent place on the licensed premises and shall produce such license if required to do so by any officer of the local authority authorized to demand the same.
Any person who fails to exhibit or to produce such license shall be guilty of an offence and shall on conviction be liable to a fine not exceeding RM500 or to imprisonment for a term not exceeding 6 months or to both. (Section 107).
