The Town and Country Planning Act 1976 which controls land use planning with the Local Authority areas. The Act empowers to consider planning applications for the purpose of land development. Basically, no development can be carried out unless planning permission for development has been obtained. In some cases, planning permission may be delayed and will lengthen the land developments process.
In addition the Local Government Act 1976 allows the Local Authority to control and supervise land development through the formulation and of a ‘structure plan’ and a ‘local plan’ which comprise of general proposals of the local planning authority for development and use of land. These are normally prepared by the Federal Town and Country Planning Department which are usually adopted by various States subjected to changes. Normally, planning approvals may take 3 years depending on the type of land development.
The Street, Drainage and Building Act 1974 also lay out the standard requirements for land development prior to the approval of the planning permission by the local authority. The Environment Quality Act 1974 also spells out rules in relation to the requirement that must be fulfilled by land developers prior to the development of land. This is to place emphasis on the importance of environmental protection from being destroyed in the land development process.
